All text, graphics, images, designs and photographs used on this website are the property of Create Galleries or their particular copyright owners. You must agree not to use, duplicate, modify or distribute any of the website’s content in any way.
We reserve the right to update and alter the website’s format and content (including the terms and conditions) without prior notice. No warranty is provided that the website will be available 24 hours a day.
Access to the website is at the users own risk, we cannot guarantee that materials downloaded are free from viruses or harmful components.
Conditions of Ordering
An order is only deemed to have been accepted when the customer receives a confirmation email from us. The time for the production of your artwork is estimated to be around 2 to 3 weeks, but as this is very much dependant on the size and complexity of each individual artwork, we cannot guarantee this timescale.
The company retains sole copyright on all created images. Although the customer can instruct us not to, we reserve the right to use this artwork in advertising and promotional displays. The customer or copyright owner retains full copyright of the original submitted photograph. The customer accepts that commercial use of the commissioned artwork is forbidden; unless written permission has been obtained from us.
Pop Art examples on our website aim to demonstrate our techniques, we do not guarantee that your commissioned artwork will resemble exactly the style and colour of these examples. The customer must be aware and accept that the colours from a computer screen display and the final proof version may differ slightly from the completed artwork.
Because of the bespoke nature of our artwork, the customer must be aware that if they cancel an order after a proof has been produced they will be liable for the design component of the order. If paid in advance, the canvas component will be refunded to the customer in this situation.
After accepting the final proof, no refund can be given unless goods are faulty.
Submission of Photographs
By submitting a photograph to us you confirm to us that you hold the copyright to the photograph or have obtained permission from the copyright holder. You agree to indemnify us against all legal fees and damages that could arise as a result of this condition being violated.
No photographs containing pornographic, obscene, racist, blasphemous or defamatory images will be accepted. Images that portray a criminal act or images likely to incite hatred against any person or group are also not acceptable.
We suggest you keep a backup of any submitted photographs/images as we cannot be held responsible for any loss or damage that may occur.
Payment
Full payment is welcome from submission of order, but is required after approval of the final proof. Credit and debit card transactions are processed through a secure payment service (Paypal). Your credit and debit card details are never retained by us. Payments via bank transfer (BACS) or by cheque are also accepted. Please note that all payments must be cleared before the final stage of production begins.
Refusal of transaction
We reserve the right under any circumstance to refuse a transaction.
Delivery
We will deliver your artwork using specialist couriers who will require someone to be present to accept delivery. We cannot be held responsible for delivery not being met.
If the item is damaged on arrival, inform the courier and do not sign for the goods. We cannot be held responsible for items damaged during transit.
Return/refunds
As we are providing personalised artwork, we regret we are unable to refund non-faulty goods.
If the artwork is faulty, contact us within 2 days of receipt and return it to us within 7 days. We will not accept returns if we do not receive prior notification. We will only acknowledge returns that have proof of delivery (e.g. Royal Mail’s signed for recorded or special delivery). Upon inspection, we will refund delivery costs incurred by you at our discretion.
This does not affect your statutory rights as a consumer.
Liability
You accept sole responsibility for the use of, or consequences resulting from the use of, any of the artworks commissioned by you.
Privacy Notice
We require certain personal data (e.g. your name, delivery address, email address and phone number) to enable us to process your order process. These data are kept confidential and shall not be shared with anyone, except for the courier firm entrusted with delivering your goods. Occasionally we may contact you with information regarding new products or special offers; you may request not to receive these infrequent updates.
